Re: Formal Complaint Regarding Environmental Nuisance.
Dear Sir/Madam,
I am writing to lodge a formal complaint regarding serious environmental issues at the neighbouring property, which is causing significant harm to my household and the local area.
Nature of the Problem:
The rear and front gardens of this property are severely overgrown and contain substantial amounts of waste. Japanese Knotweed and bindweed have consumed approximately 85-90% of the front garden and the entire rear garden. The infestation is now clearly visible from the roadway due to the absence of a rear gate and adjoining fence panel.
Discarded items including a bed base, mattress, couch, and trampoline are visible from the street. An untouched, disused car is partially consumed by the vegetation. Four fence panels and two fence posts on my property have been destroyed as a direct result of this infestation, requiring multiple repairs.
The overgrowth has damaged a garden shed on my property. Evidence of rat infestation has become apparent, with holes visible in both fence panels and the shed structure. The front garden vegetation has rendered three windows of the property non-operational and has reduced the public right of way by approximately 60 centimetres.
Additionally, despite being previously instructed by council services that a streetlight and its base must remain accessible, the vegetation obscures both.
Impact
These conditions pose a genuine risk to my family's health and safety. I am unable to allow my daughter or pet to access our garden unsupervised. The infestation creates a clear pest control risk to neighbouring properties.
Previous Action
I have discussed this matter with the resident on multiple occasions over approximately 12 years. The resident has repeatedly promised to address the issues without taking any action. I have previously raised complaints with the council without resulting improvement.
Legal Basis for Council Action
I am requesting that the council exercise its powers under the Environmental Protection Act 1990, Section 79, which defines a statutory nuisance as a matter prejudicial to health or a nuisance. The uncontrolled vegetation, pest infestation, and obstruction of public rights of way fall clearly within this definition. The council also has powers under the Town and Country Planning Act 1990 regarding garden maintenance affecting the amenity of the area.
Requested Action
I request that the council:
1. Serve notice upon the owner or occupier of 20 Goldsmith Road requiring clearance of all invasive vegetation, removal of waste items, and eradication of the Japanese Knotweed infestation in both front and rear gardens.
2. Require reinstatement of fencing and gates to a proper standard.
3. Require pest control measures appropriate to address the rat infestation.
4. Require that the streetlight and its base are made fully accessible.
5. Take enforcement action, including prosecution if necessary, should the resident fail to comply within a reasonable timeframe.
I am maintaining a detailed diary of incidents and environmental concerns, which I can provide to support this complaint. I would appreciate a substantive response within 10 working days, detailing what action the council intends to take and the timescale for enforcement.
